Good evening.
Both of the Associations (Superintendents and Inspectors) were called by the Board today. First meeting was held with the Member (P&V) alongwith DG & ADG of HRD to request the Associations to defer/withdraw the programme. The Associations said that both would sit together before giving any final reply. After it, both Associations sat together and discussed all ‘if & buts’ and decided to defer the programme for the time being as a combined decision. Then again, both sat with Member (P&V) and further with the Chairperson.
Chairperson was of the views that we don’t know how much revenue we would lose by our strike or how much we gain by attending the office but at least this is the time to stand in support of FM to give him the due message to get our work done from him without any adamant attitude. We were intimated by both that the Cadre restructuring file is already on the table of FM after clearance by RS. They assured that the same would be pursued with him and, in all probabilities, a positive decision by him is very much expected after his return from abroad. The Board and RS have recommended the revival of the 4896 posts of AC/DC which were scaled down to 3600 during the 1.3.12 meeting between the then FM and DOPT Minister. After clearance by the FM, the file will go to the DOPT/cadre review committee. They further assured that the FM would also be pursued to get the same cleared by DOPT/cadre review committee by using his influence. It was also clarified by the top brass that the need to send it again to the Expenditure will also expectedly be covered in FM’s clearance. They also expected that the cadre restructuring of both, CBEC & CBDT, would be cleared together by the cabinet.
As regards other demands of the Association, it was assured that all of the issues would be dealt with priority now onward. DG, HRD was directed to write to the UPSC and pursue the matter for holding of the DPC for promotion to the existing vacancies of Asstt. Commissioner at the earliest. The concerned DS was also directed to immediately issue the letter regarding not to offset ACP benefit with time scale. He was also directed to take necessary action on the Board letter issued under the signature of Sh. Dharmvir Gupta for payment of arrears to our officers (then Inspectors) since 1986 at par with the Inspectors of CBI and IB. He was also directed to put up the letter sent by the Expenditure in regard of anti-dating of the pay scale of the Superintendents. It was also assured that the action on the other issues as discussed in the meeting of 31.1.13 would also be taken and a further meeting would be held soon before expiry of 3 months.
Accordingly, both the Associations took the decision to defer the programme of 29-31.3.13 for the time being. As far as the programmes of 12.4.13 (to march to the residence of FM in uniform) and 30.4.13 (mass resignations) are concerned, the same stand as it is if no further change happens in the situation.
The Association appreciates and thanks all of its units and members for the all united and strong message given by them to the concerned authorities. All are requested to kindly keep the morale and spirit ever high and be prepared for every future programme, if all of our grievances are not redressed within due time. Some may not be happy with this deferment and some other may be satisfied & happy considering it a mature step as per the circumstances. Despite of the possible diverse ideologies, all are requested to be ‘all united’ to give them the ‘strongest’ message in future too. The actual aim to mount the required pressure on them was fulfilled in a very remarkable manner, all are thanked very much to show the required spirit despite of the ‘acute time constraint’. All of us, who were active for the cause of cadre, really deserve ‘high kudos’.

LETTER TO STAY AWAY FROM OFFICE HAS BEEN WITHDRAWN

AFTER RECEIVING A MAIL FROM FEDERATION THAT A MEETING WAS HELD WITH MEMBER(P&V) AND IT HAS BEEN DECIDED TO DIFFER THE ON GOING STRIKE OF AIACEGEO. ACCORDINGLY, THE  TIRUPATI UNIT HAS WITHDRAWN THE CALL GIVEN TO STAY AWAY FROM OFFICE ON 29TH TO 31ST MARCH,

     In response to Federation i.e. AIACEGEO's call for staying away from office on holidays from 29th to 31st March,2013 by all Superintendents, we the Tirupathi Unit of AIACEGEO has served the letter along with charter of demands and SG letter to Finance Minister to the Commissioner, Tirupati Commissionerate  informing about our decision to stay away from ofice from 29th to 31st March,2013.

1.             Inter Zonal Transfer Policy for Superintendents of Hyderabad CCA:

  It is learnt that the IZT Policy has been finalized and is likely to be issued by tomorrow. It is reliably learnt that IZT Policy has been finalized and a copy of the same has been sent to Vizag CC and the same is likely to be released officially by tomorrow i.e. 28-3-2013.
2.     Intra-Zonal Transfer Policy (Inter-Commissionerate Transfer Policy ) for Officers of Hyderabad Zone:

       For the  first time a separate transfer policy for Superintendents and Inspectors of Hyderabad Zone is likely to be formulated. CC-Hyderabad Zone has held meeting with the concerned Associations of Hyderabad Zone  yesterday i.e. 26-3-2013.  It is learnt that this policy is also likely to be released simultaneously along with IZT Policy.
3.      Creation of separate Customs Commissionerate in Hyderabad:

It is learnt that the CC-Hyderabad has proposed to create separate Customs Commissionerate in Hyderabad and proposals to this effect are likely to be sent to CBEC.  It is also learnt that CC-Hyderabad has mooted a proposal to man the RGIA Airport and other Customs Postings like ICD/ACC from the sanctioned strength of Hyderabad-II Commissionerate. Officers will be deputed to RGIA Airport based on Board norms for International Airport and against local quota in Airport Pool, it is learnt that only officers from Hyderabad-II Commissionerate are likely to be deputed after giving due weightage for the officers of Vizag Zone also.  Modalities for a permanent and transparent policy for manning of RGIA and the deputation of officers are likely to be issued in the ensuing ICT Policy.

Young aspiring graduates, enter the Department as Inspectors, after qualifying the National level recruitment exam like Staff Selection Commission exam, looking for a bright future. But it is pathetic, for many of them, as they have  realized  it too late that they shall retire with only one functional promotion in the entire career span of their Government Service, with the existing policies. The reason being  STAGNATION in a single cadre, spreading over decades, which is alarming and disheartening. The fact is that such stagnations differ from Zone to Zone. Some of the worst affected Zones, being Pune, where a 1992 Batch Inspector is still awaiting his first ever promotion. With the current pace, it might take another one year to get promoted. Its an alarming  wait of 22 years, which is totally ridiculous, and belittling an officer. Though the Government has implemented the cash compensation scheme through MACP, as a temporary solution for such staggering stagnations, it cannot be equated with the JOY of getting a Promotion. Its a moral boost for the officer and the family. Its rejuvenating the working force for the Department as well.  The ongoing Cadre Restructuring proposal could have removed this HUGE stagnation persistent in the cadres of Inspectors and Superintendents. Had it been a reality, even the subordinate cadres would have benefited. But this much talked CR seems to be a distant dream, the way it is being handled, over the past several years. The Associations are putting their best efforts to get justice to their members by adopting various agitation programs like boycotting the Excise day celebrations, Budget days, relay hunger strikes, wearing black badges as Protests, mass resignations, etc., besides fighting out the various issues in the Court of law.  All these efforts should be sincerely appreciated, as they are the part of the struggle to get the final result. 

 


                Can we all come together, irrespective of our Cadres we belong to,  and think something new. The Associations are always in the forefront, and members persuade them to get the best results. It appears that even the Members contribution in Body and Soul is equally important  to  bring force to our movement. Lets think of placing an “APPEAL” before the Department/ Government. Well you shall ask whats new in this.  This “APPEAL”   be tagged with a “Blood Donation Drive”. By this Appeal, the officers can once again resolve to PLEDGE their devotion and solidarity towards their Duties and the Nation at Large. In support of their Pledge, the officers may volunteer to donate “Blood”, so as  to reach out to the common man by saving a life, which is a part of the Nation building process. The participation of the members, in this unique way,  will be a big driving force to once again emphasize and  press for our genuine demands. This thought is driven from  our National leader Netaji Subhash Chandra Bose, who once said…” Give me blood and I will give you freedom”. This APPEAL along with the Blood donation drive will be with three prime objectives:

 


1.       SAVING a valuable life;


2.       A PLEDGE , Expressing their  Devotion & Solidarity towards their Duties & the Nation at large;


3.    APPEAL to RESTORE DIGNITY by considering the Charter of Demands which are JUST demands, so as to remove stagnation, by implementing Cadre restructuring, removing regional disparities by bringing base cadre seniority for promotions to IRS Cadre, minimum 3-4 functional promotions for Insprs./ Supdts. in one’s  career span.


 

INcome Tax Cadre Review and Restructure : Cabinet nod likely on 21st March 2013

It is learnt from ITEF sources that much awaited cadre review proposal, after clearance of Committee of Secretaries, now endorsed by Finance Minister on 12th March and submitted for cabinet approval. Next cabinet meeting is scheduled on 21st March and possibly it may be cleared on that very day.

1. Heard Mr. Vikas Singh, learned senior counsel in support of the first contempt petition and Mr. J.K. Das, learned senior counsel in support of the second contempt petition. Both these petitions are filed alleging breach of the order dated 3.8.2011passed by this Court in Civil Appeal No.1198 of 2005 and Writ Petition (Civil) No. 385 of 2010. The petitioners in the first contempt petition belong to the cadre of Superintendents of Central Excise, whereas the petitioners in the second contempt petition belong to the cadre of Superintendents of Customs (Preventive). There is one more cadre of the same rank which is that of Customs Appraisers. The posts in these three cadres are Group B posts. They are the feeder cadres for promotion to the posts of Assistant Commissioners (Central Excise & Customs) which are Group A posts.
2. These three cadres were then having the ratio of 6:1:2 for promotion to Group A posts. The issue was with respect to the proper representation of the three cadres. When the above referred writ petition and civil appeal were heard, this Court did not express any opinion on the merits of their claims, and it was left to the Government to alter the existing ratio after considering the representations of all the parties concerned. While disposing of the appeal and the writ petition this Court gave certain directions. Direction No.4 out of them read as follows:
“4. Having perused one of the Office Orders (No.51/2011 dated 18th March, 2011), whereby
some officers were promoted from Group 'B' to the grade of Assistant Commissioner of Customs & Central Excise in the Pay Band 3 with Grade Pay of Rs.5400/- on purely ad hoc basis, we direct that all such ad hoc promotions shall abide by the final decisions to be taken by the Department in terms of this order.”

3. It has so transpired that the relevant rules have been subsequently revised and now the quota for the three cadres for promotion to the Group A posts is in the ratio of 13:1:2. The new quota is made applicable prospectively.
4. The submission of the petitioners is that by this Court's order dated 3.8.2011, directions were issued to the respondents which have not been complied with by them. The petitioners contend that this direction No.4 implies a retrospective application of the revised formula on the quota for each cadre, since the promotions effected in the meanwhile were on an ad hoc basis. That was not done.
5. Mr. Amarendra Sharan, learned senior counsel appearing on behalf of the intervening parties, Mr. Rajiv Nanda appearing for the Union of India and Mr. Patwalia, learned senior counsel appearing on behalf of the private respondents submitted that the submission made on behalf of the petitioners is erroneous. The order did not state anywhere that the quota when changed will apply retrospectively. At best it could be said that according to thepetitioners the implementation was not in conformity with the directions of this Court passed on 3.8.2011, but there is no disobedience, whatsoever, of the directions in making the newly formed quota applicable prospectively.
6. Having noted the submissions of both the parties, we are in agreement with the submissions made on behalf of the Union of India as well as the intervenors. All that the order dated 3.8.2011 says is that the ad hoc promotions made in the meanwhile will abide by the final decision to be taken by the Department in terms of Office Order. There is no direction to apply the new quota retrospectively. We do not see that there is any contempt of this Court's order dated 3.8.2011 by the respondents. The contempt petitions are accordingly dismissed.

Details of all Associations meeting with CC-Hyderabad for framing of new IZT Policy held in Hyderabad on 11-3-2013 and also meeting of all Associations (AIACEGEO) of A.P. in Hyderabad held on 10-3-2013..


As informed earlier, we have attended the meeting convened by  CC-Hyderabad today i.e. 11-3-2013 at 11.30 AM. All Superintendents Associations of A.P. i.e. Hyderabad, Tirupati, Guntur, Vizag I & II   have attended the meeting.  This is a joint meeting of all the Superintendents and Inspectors Association of Andhra Pradesh for framing of IZT policy for Superintendents and Inspectors separately.  Apart from Chief Commissioner, Hyderabad, all Commissioners of Hyderabad Zone i.e. Hyd-I to Hyd-IV have attended the meeting.  All  Additional Commissioners (P&V) of Hyderabad Zone  have also attended the meeting. Smt. Shiva Nagakumari, Commissioner, Vizag-II has represented the  CC-Vizag Zone.

            Though as scheduled all the Branch Associations of AIACEGEO of A.P. have met in Hyderabad yesterday, a common memorandum based on common minimum programme, though arrived at after much consultations and confabulations, has to be abandoned at last minute due to some unforeseen circumstances from Hyderabad Zone Branch.  

            On behalf of Tirupati, we have reiterated whatever points we have submitted to both the Chief Commissioners personally on 12-12-2013 and 13-12-2013, which are summarized as detailed below.

1.      To reduce the present promotion tenure from three to two years due to peculiar local conditions prevailing in A.P.
2.      To continue the present rotational tenure of one year.
3.      To give only one year tenure on promotion to  Vizag Zone to the lady officers.
4.      To change the present days based tenure to years based i.e. instead of 330 days to one year and so on and to allow all  entitled leaves  except loss of pay leaves to the concerned officers during their tenure in Vizag Zone.
5.      To repatriate all the officers of Hyderabad Zone working in Vizag Zone back to Hyderabad Zone irrespective of completion or non-completion of their prescribed tenure on implementation of Cadre Restructuring.
6.      To reduce the present residency period of eight years for Vizag based officers to be eligible to apply to Hyderabad Zone to five/four years.
7.      Exemption from tenure transfers to Vizag Zone should be given on extreme medical grounds, children education of either tenth or intermediate second year and on spouse grounds.
8.      To exclude all the deputation tenure i.e. deputations to SEZs, Airports, Directorates etc. of the officers of Hyderabad Zone working in Vizag Zone  should be excluded from their prescribed Vizag tenure.
9.      To repatriate all the tenure completed officers to Hyderabad Zone  immediately on completion of their tenure irrespective of availability of substitutes or not in their places.  
10.  To furnish a Draft Transfer Policy to us before its finalization.

We have presented our case vehemently, forcefully and persuasively to the Chief Commissioner. There seems to be a consensus among all the Branch Associations about the said exemptions. Though Hyderabad Zone Branch has also supported the reduction in promotion tenure to Two years, it  has broadly asked for continuation of the existing IZT policy. Guntur and Vizag based associations have requested for removal of the present cap of five officers per annum  who come to Hyderabad or to increase it to at-least 10. Guntur and Vizag based associations have also requested for reduction in residency period from the present eight years to three years.

Chief Commissioner has also elicited the views from all the Commissioners and has noted down personally all the points raised by all the Branch Associations. Chief Commissioner has promised to give a transparent and mutually accepted transfer policy by making only minimum changes to the existing transfer policy. Chief Commissioner has stated that a draft transfer policy will be circulated to us latest by 13-3-2013 after which it will be finalized by the end of this month.

Since the Chief Commissioner is going on training programme in ISB-Hyderabad  from 1stto 11th of April,2013 and in USA from the second week to the last week  of April,2013 and on leave in the first week of May, it is hoped that Final IZT policy will be issued by the end of this month.

LETTER FROM PRESIDENT/AIACEGEO COM. LOKNATH MISHRA

All Members of AIACEGEO.

Comrades,

At the very outset, I would congratulate all members of AIACEGEO for successfully implementing the Agitation call given by the Association in pursuit of our genuine and just demands.

All our Members may also note that vide letter dated 26.02.13, the Member(P&V) has informed that CR proposal of CBEC is at advance stage of approval. Whereas vide letter dated 15.02.2013, Board has informed that- ' FM had sought some clarification on some proposals and Board is finalising the reply to these clarification and will be submitted before FM very soon'.- Hence there is no meaningful outcome from the assurance letter issued by Member(P&V)CBEC.

We have decided to tread the path of agitation only after a threadbare discussions in our AEC Meeting and after giving due notice to FM . We sincerely believe that the demands raised are not only genuine, but are vital for the very survival of our members both literally and career-wise in the Department. We will conduct our AC meeting on 16.03.13 at Delhi to review of the agitational programme. The SG has already served the notice for such meeting stating the following-

-'Associate Committee Meeting will be held at Delhi on 16.03.13 at Hotel Solitaires, opposite Laxminagar main market, near Laxminagar Metro station, 37th Metro Pillar, Shakarpur, Vikas Marg, Delhi. Meeting will start at 11 a.m. on the single agenda of review of agitational programme.
All of the zonal office bearers may kindly make it convenient to attend the meeting. The office-bearers coming to attend the meeting may send their confirmation within 5 days directly to the Office Secretary, Sh. C. S. Sharma, keeping in view the proper arrangement of fooding.
No need to say that all the zonal office bearers may also kindly get the views of the units of respective zones on the issue before coming for the meeting'--.

All the Unit Secretaries are therefore requested to send the proposals/suggestions of their respective units with reference to revival of the present agitational programmee to AIB through the regional Vice Presidents and Joint Secretaries for discussions in the meeting.

A request letter has been written to AICEIA seeking their support for the agitation and with a request to join in the agitation. In many places Inspectors have also joined in our agitational programme locally. With the support of AICEIA, we are sure that the haughty Administration will have to eat a humble pie and resolve all our issues.

The boycott of Central Excise Day on 24-25.02.2013 and lunch hours demonstration on 01.03.2013 , for which the call was given by the AIACEGEO was a tremendous success and these can be described as -'GLORIOUS'-. Not only the Superintendents & Inspectors but also other staffs of Central Excise Department supported the strike action throughout the country. The overwhelming response in the mightiest strike action ever of the Central Excise Department is indicative of the growing anger against the defective HR policies pursued by the CBEC. There had been constant and continuous increase in stagnation problems and anomalies on pay matters amongst the employees in Central Excise Department.

All members are requested to be prepared to SUBMIT RESIGNATION ON 30.04.2013 and resolutely fight against the divisive and partisan attitude of the Board, which is systematically being resorted in a calculated manner such as to adversely affect the career prospects of all Central Excise Gr-B officers ( both Gazetted and non Gazetted). Leaders of all Units are requested to conduct awareness programme in their respective regions, by giving adequate publicity to this and strive their best to keep the morale of officers at an exalted level, which alone can ensure better performance for one & all.
With greetings and once again conveying my sincere gratitude and congratulations to all the Superintendents/Inspectors of Central Excise and the active leaders of AIACEGEO & AICEIA who made the strike ( boycott of Central Excise day and lunch hours demonstration on 01.03.13 ) a magnificent success.
