Hyderabad-I Commissioner has issued IZT order for 10 supdts from Vizag to Hyderabad vide Estt. Order .GO.No.20/2014 dated 20.5.2014 and retained two Supdts in Hyderabad who were promoted recently.

AN OVERVIEW OF CR IN CBEC

As per the approved plans, the CBEC will have as many as 119 Central Excise Commissionerates; 22 Service Tax Commissionerates, 60 Customs Commissionerates and 45 Audit Commissionerates. Since Mumbai has the largest number of service tax assessees it has been given as many as FIVE SERVICE TAX Commissionerates; followed by FOUR for Delhi; THREE for Chennai; TWO for Bangalore and ONE each for Hyderabad and Pune.
Noida which has emerged as a key industrial hub in the NCR, is going to be split into many Commissionerates - ONE Service Tax Commissionerate and an independent Customs Commissionerate. To accommodate regional aspirations, Uttaranchal has got Dehradun Commissionerate. Similarly, Telengana will have one Central Excise Commissionerate. In Seemandhara, Kakinada and Vijayawada will have independent Customs Commissionerates. In Punjab, Ludhiana will be a new Customs Commissionerate. The Tughlakabad ICD is going to be split into two independent Customs Commissionerate. To keep Haryana happy, Sonipat will be a full-fledged Central Excise Commissionerate. Goa will have two independent Customs and Central Excise Commissionerates. For Gujarat, Mundra Port will be a full-fledged Customs Commissionerate. Vadodara and Ahmedabad will get two Audit Commissionerates. In the East, Ranchi will be split into two Commissionerates and a new Commissionerate will be created in Dhanbad.
As per sources in the CBEC, Madhya Pradesh will get two new Central Excise Commissionerates in Jabalpur and Bilaspur. Kolkata will get one more service tax commissionerate along with an Audit Commissionerate. Bangalore Customs is going to be split into two separate commissionerates and will also have an Audit Commissionerate. India's busiest port Nhava Sheva is going to have more Customs Commissionerates. Similarly, Chennai will have more Customs Commissionerates. For Guwahati which never had its own sanctioned staff, it will be getting hundreds of sanctioned posts and will also have an audit commissionerate. In total, there will be as many as 60 appellate commissioners and the rest out of 440 sanctioned posts of Commissioners will be bagged by the Directorates.
As per the Board, they are going to notify the sanctioned posts in less than a week; followed by the creation of new commissionerates and finally, the distribution of manpower in the coming months. Only in future, after a review, the idea is to reduce the number of Central Excise Commissionerates and go for more of Audit Commissionerates.
Let's hope the CBEC is able to speed up the process of implementation of Cadre Review and also give more hands to its own DG(HRD) which is terribly understaffed and overburdened. For a smooth implementation and an efficient upkeep of HR records, it would be in own interest of the CBEC to arm its HRD with more manpower for smooth roll-out of the cadre restructuring plans.

Implementation of CR in Hyderabad CCA


I.                   Formations in Hyderabad Zone:
Central Excise Commissionerates :  4
Service Tax Commissionerate       :  1
Audit Commissionerate                :  1
Customs Commissionerate            :  1

Hyderabad ‘J’ Division  of Hyd-III Comm’te and Kathedan and Gaganpagad Ranges of Hyderabad-IV Comm’te will be added to Hyderabad-II Comm’te in addition to its present jurisdiction.

II.                Formations in Vizag Zone:

Central Excise Commissionerates : 5
Audit Commissionerate                : 1 ( to be located in Vijayawada)
Customs Preventive Comm’te       : 1 ( to be located in Vijayawada/Kakinada)
Present Customs Commissionerate in Vizag Custom House will continue.

In place of present four CE Commissionerates, one new CE Commissionerate is proposed to be created in Kurnool or Kadapa with three districts (Kurnool/Kadapa, Ongole and Nellore).

III.             Division of CE Commisionerates in to Fat and Lean:

Based on work load, all the CE Commissionerates will be treated as Fat or Lean.
Fat Commissionerate will have a sanctioned strength of 80 Supdts and Lean Commissionerate will have 50 Supdts.
  
IV.             AGT and IZT Transfers:

It seems CC-Hyderabad has decided to effect AGT and IZT  tansfers along with implementation of CR before June 15th.  However, around 15 Superintendents who have completed their prescribed tenure of 990 days in Vizag Zone will be repatriated to Hyderabad Zone by way of mini IZT order against the latest promotion order.
V.                Manpower of proposed two Customs Commissionerates:

It seems all the posts of Group-B of the proposed two Customs Commissionerates in Hyderabad Zone and Vizag Zone have allotted to Central Excise pool.

 Para 126.5 of 5th Central Pay Commission  reads as under: 
Extending judicial decisions in matters of a general nature to all similarly placed employees. - We have observed that frequently, in cases of service litigation involving many similarly placed employees, the benefit of judgement is only extended to those employees who had agitated the matter before the Tribunal/Court. This generates a lot of needless litigation. It also runs contrary to the judgment given by the Full Bench of Central Administrative Tribunal, Bangalore in the case of C.S. Elias Ahmed and others v. UOI & others (O.A. Nos. 451 and 541 of 1991), wherein it was held that the entire class of employees who are similarly situated are required to be given the benefit of the decision whether or not they were parties to the original writ. Incidentally, this principle has been upheld by the Supreme Court in this case as well as in numerous other judgments like G.C. Ghosh v. UOI, [ (1992) 19 ATC 94 (SC) ], dated 20-7-1998; K.I. Shepherd etc. Accordingly, we recommend that decisions taken in one specific case either by the judiciary or the Govt. should be applied to all other identical cases without forcing the other employees to approach the court of law for an identical remedy or relief.  Recently, CAT Principal Bench has issued direction on 12.03.2014 in OA No. 864/2014 that once an order has been passed by this tribunal and it has also been upheld at the level of the Supreme Court, there is no question of waiting for an approval from any Govt. department for implementation of the same.

Clarification on CR by Com.Loknath Mishra

CR file was ready for approval on 31.03.14, but it could not be approved on that day by FM. The then Secretary ( R ) marked the file to FM for approval and still then it is lying in the office of Secretary ( R) . Meanwhile the leaders of one Association met the new Secretary ( R ) and submitted representation for preparation of all India seniority list as per SC decision in Radheshyam Sing case. The Secretary ( R) is still examining the issue either to submit it to FM or to return the file to CBEC with certain remarks. Therefore it is very difficult to say when CR will be approved by FM. Except these everything are rumors only. Of course if CR will be delayed many innocent friends will be retired without getting promotion. Moreover it will also be very difficult to say when the same will be approved.
