UPDATE ON GP 5400 TO ACP INSPECTORS- CAT OA 1051/2010 IS BEING APPEALED BY DEPT IN AP HIGH COURT- CAVEAT FILED
THE DEPARTMENT FILED APPEAL IN HON'BLE HIGH COURT OF A.P.HYDERABAD AGAINST THE ORDER OF CAT HYDERABAD IN OA NO. 1051/2010. I HAVE ALREADY FILED CAVEAT IN AP HIGH COURT. MOST PROBABLY THE MATTER MAY BE POSTED ON MONDAY THE 17TH DECEMBER 2012.

Meetings of AIACEGEO, Tirupati Unit with Chief Commissioner, Vizag Zone and Hyderabad Zone and Commissioner, Hyderabad-I
As already informed we met Chief Commissioner, Vizag Zone in Vizag
on 11-12-2012 and Chief Commissioner, Hyderabad Zone and Commissioner,
Hyderabad-I Commissionerate in Hyderabad on 12-12-2012.
Meeting with CC-Vizag on 11-12-2012:
The meeting went on for about an hour. CC was receptive and amiable. We have explained in detail about the contents of our Memorandum. We have highlighted the provisions of Presidential Order,1974 and Presidential Order, 1975 about the local and non-local status of our Wards for admissions into Higher Education colleges in our state and eligibility for public employment in the State Government. Based on these unique local factors and conditions, critical status of personal and family life in which all the officers are placed at this juncture including education of their wards, their financial position and tenuous health conditions of their aged parents, we have tried to impress upon the CC, inter-alia, on the following:
1. To minimise the dislocation of the officers of Hyderabad Zone to Vizag Zone either on promotion or on rotation and undertake a scientific and rational study on the need to send officers of Hyderabad Zone to Vizag Zone and to find a logical solution to this perennial and pestering problem.
2. To reduce the present tenure of three years on promotion to Vizag Zone to two years keeping in mind different yardsticks and legitimate reasons as enunciated in our Memorandum.
3. To do away with regular rotation for the officers of Hyderabad between Hyderabad and Vizag Zone in view of large scale promotions expected to Superintendent Cadre against superannuation vacancies, implementation of CR and consequential vacancies arising out of promotions to Group-A and if this is not possible, to continue the present tenure of one year on rotation.
4. To keep the tenure in years instead of days. For example if the promotion tenure is two years, it has to be shown as two years but not as 660 days.
5. To allow all the entitled leaves including medical, maternity, paternity, child care, earned leaves etc. to all the officers within the prescribed tenure.
6. To repatriate all the Hyderabad Officers from Vizag Zone to Hyderabad Zone after implementation of CR irrespective of completion/non-completion of the prescribed tenure.
7. To extend exemption to certain class of officers as specified in the Memorandum.
On two issues Chief Commissioner was not supportive of associations demands i.e. reduction of tenure to two years, to maintain the one year rotation tenure and to allow all the entitled leaves within the prescribed tenure. CC has explained us the need to increase the tenure from three years to five years to avoid regula r rotation between the two Zones. However, we have taken pains to explain the need to reduce it to two years instead of raising it keeping in mind the educational, financial, family and social needs of our family and also to consider to repatriate all the Hyderabad Officers from Vizag to Hyderabad once CR is implemented without waiting for completion of the prescribed tenure.
After deep persuasion and explanation, CC has come down to four years instead of five years. However, he wants the rotation tenure to be two years at any cost. On other issues, he said CC-Hyderabad can taken his decision. However, we are hopeful that with more interaction with him by other Branch Associations like Vizag and Hyderabad, we can persuade him to think of reducing it two years or to atleast maintain the present three years.

Our meetings with CC-Hyderabad and Commissioner-I, Hyderabad went off well and both were encouraging. We have explained in nut-shell our views and suggestions to both of them. They said they are positive and have open mind about all issues. However, the promotion tenure appears to be a tricky one and it requires a great panache and persuasion skills to enable them to accede to our request. However, both CC and Comm-I looked to be positive about maintaining the present tenure of three years on promotion and as far as the rotation tenure is concerned it seems they are also veering around to the view that it has to be increased to two years.
On other issues like repatration after CR, allowing leaves within the prescribed tenure etc, they said they will discuss and decide all these issues during the meeting with all the associaitons. We have requested them to convene meeting with all the Associations including our Tirupati Unit in A.P. and to supply copy of Draft Transfer Policy to the Associations before it is finalised for which they have agreed.

Update by VP-AIACEGEO on Contempt Case – Supreme Court Contempt Verdict – Postponed
The
ruling of the Apex court in the contempt case which was scheduled to be
delivered today has been pushed to March 2013 dashing the hopes of
many a central excise officers ( Superintendents) who have been working
for the past twenty years without any promotional avenue.
The sources in Pune who are fighting the contempt case have stated that the case was listed at serial number one on 11-12-2012 and remained there till yesterday before mysteriously disappearing .They have further added that efforts are being made to get the case listed and heard at the earliest by way of an out of turn hearing.
What is very intriguing is the sudden removal of the case from the case listed scheduled for hearing on 11-12-2012.At present it is not very clear as to why and how the same has happened with such alacrity.
Meanwhile the Federation has also resolved to take up the matter with all those concerned to seek justice for the badly affected feeder cadre of Superintendents by way of conduction of a DPC for the existing vacancies .The Secretary General has addressed the CBEC in this regard.
Our sympathies lie with the hundreds of officers across the country who face the prospect of superannuating with just one promotion in a career spanning four decades. We shall keep you updated with any developments on this front.

General Body Meeting of AIACEGEO, Tirupati Unit was held on 4-12-2012 as scheduled. Discussions took place on the points detailed in the Agenda. Several resolutions have been passed. Subscriptions forms from Members have been collected. A new body for the next two years has been elected. The following is the list of new body.

MESSAGE FROM COM.KOUSIK ROY
The In-situ promotion scheme was re-discussed with the present member
(P&V) by the AICEIA leadership on 3rd October 2012. Accordingly
Secretary General of AICEIA asked details of service length of
Inspectors working in different cadre controlling zones; a letter in
this regard issued and published in the bog of AICEIA. Fortunately I
was a part of that delegation; what I understood that this would be
another chance for discussion and taking appropriate decision,
simultaneously it is equally possible that a group of knowledgeable
members of different organisations and officers of the CBEC may not
consider it as a feasible way of removal of stagnation. From our earlier
experience we understood that Present Chairman was pro-active to scrap
the earlier proposal for in-situ scheme.
Then what is the solution :
Inspector and Superintendent Association should join hands immediately and launch an Industrial action, it is suggestive to take the appropriate opportunity of the Strike call given by the Central Government employees and workers on 12-12-12; in this strike call amongst the 15 point charter of demands there is one demand which reads as :
REMOVAL OF BAN ON CREATION OF POST
This is one of the key instrument what government of India and its key department D.O.P&T utilising to hold the restructuring process in various departments inclusive of ours. hence, time is ripe enough to take appropriate decision.
Then what is the solution :

Correction to the following post
There is some mis-understanding. Board has not allowed stepping up of
pay in case of senior drawing less pay than junior due to up gradation
of pay scales w.e.f 21.04.2004 (though it was illegal and our
associations have not made serious efforts in this regard except
writting some letters to CBEC). A proposal has been prepared in this
regard (to give stepping up) for forwarding it to DOPT. it has not even
been put up to JS (Admin), CBEC and I think it may take 2 to 3 months to
get it approved from DOPT.

The case in the matter in Hyderabad High Court is still pending, though the applicants were already granted upgraded pay as no stay was granted by high Court.

Apex court in the case of Ashoke Kumar has allowed to step up of pay at par with juniors in case of senior was not allowed ACP benefits. But department allowed such step up of pay in person. We represented to Board to implement such order to all other officers. Though Board has accepted our views, but not yet has issued any order. Meanwhile in case of senior drawing less pay than the junior due to upgradation of scale during 21.04.2004 the Board has allowed stepping up of pay as off case in relaxing the conditions of ACP scheme.

"Please recall the meeting with the Member (P&V) held on 02.11.12 when the charter of demands submitted by you alongwith your representation Ref. No. 66/M/12 Dt. 29.10.12 were discussed. During the meeting, the issues pertaining to cadre restructuring proposal, scheme of grant of in-situ promotions and holding of regular minuted meetings by the senior officers of department with the representatives of Group ‘B’ gazetted officers were highlighted.
2. In this context, the department would like to assure that all the efforts are being made to get the cadre restructuring proposal approved by the competent authority as soon as possible. As regards the introduction of the scheme for the grant of in-situ promotions, I would like to inform you that the modalities of the scheme are being worked out and would be submitted to CBEC for consideration shortly. Finally, the Member (P&V) has directed the concerned section of CBEC to issue the necessary instructions to the Chief Commissioners/Director Generals to regularly hold meetings with the representatives of Group ‘B’ gazetted officers in order to address their grievances.
3. In view of the fact that your major demands are under active consideration of the department and the department is committed towards addressing your grievances in the best possible manner, you may like to defer the proposed agitation programme to enable the department to take the necessary steps to mitigate the grievances of the cadre which you belong. The next meeting to review the progress in the matter is fixed for March, 2012.

THE APPRAISERS PLEADED TO INTERVENE IN THE CONTEMPT BUT MR VIKASH SING ADVOCATE OF PUNE OBJECTED THAT IN CONTEMPT THERE CAN NOT BE ANY INTERVENTION PETITION AS CONTEMPT IS AGAINST NON IMPLEMENTATION OF SC ORDER BY GOVT. COURT ACCEPTED THE OBJECTION AND REJECTED THE INTERVENTION PETITION OF APPRAISERS. THOUGH COURT HAS NOT ACCEPTED THE CONTEMPT BUT DEFINITELY GIVE VERDICT FOR REGULARISATION OF ADHOC PROMOTION ON THE BASIS OF NEW RR OR REVISED RATIO APPLICABLE DURING RELEVANT TIME. REGARDING CHALLENGING THE NEW RR APPROPRIATE ACTION IS BEING INITIATED.

we will discuss about adhoc regularisation. After issue of minute only , I can post here actual what have been promised by Board . However it was decided that all the points as discussed in the meeting held on 02.11.12 should be examined and those are in competency of Board should be considered immediately and the rest are to be forwarded to concerned department with a favourable noting and with a special mention that since the Association is agitating, these are to be considered in a one time messure relaxing all the procedures. ( there was discussions on 34 points but main points are parity on pay and promotions/ MACP etc.
