इस मुद्दे पर सी. बी. आई. के वेतन साथसमानता निरीख्रकों द्वारा उठाया गया थाश्री राम चन्द्र खूंटिआ, माननीय संसद सदस्य के 24 मार्च में प्रस्तुत २०११ राज्य सभा में बहस के दौरान वित्त विधेयक पर २०११ ।


महोदय, मॅँ यह उल्लेख करना चाहूंगा के बारे में यहां एक बात प्रणाली की रीति-रिवाज हैं. के विभाग में सीमा शुल्क और उत्पाद शुल्क, निरीख्रक बहुत ही महत्वपूर्ण है । एकत्रित कर रहे हैं उन्हें पैसा लिया है । जैसा कि मु३ो बताया गया, सीमा-शुल्क निरीख्रकों को मिलने पर उनके वेतन तथा भत्तों के समतुल्य निरीख्रकों और अन्य निरीख्रकों सी. बी. आई. । थे । उनके वेतन तथा भत्तों में कमी के चौथे और पांचवें वेतन आयोग । अब, छठे वेतन आयोग, इनकी दुर्दशा को देखते हुए, सरकार ने बहुत प्रकार किया गया लाने के लिए पर्याप्त उन्हें समता; लेकिन, उन्हें अपनी काल्पनिक पदोन्नति से प्राप्त 1996 वे बहुत ज्यादा व्यथित में स्थिति पैदा हो गई है । वे बहुत दुखी है । माननीय मॅँ माननीय वित्त मंत्री जी को इस पर विचार करना चाहिए देने के लिए उनके मामले में उन्हें काल्पनिक है क्योंकि यह संवर्धन को दे दी गई सभी अन्य 16 सेवाओं में इस देश में हैं ।






THE ISSUE OF PAY PARITY WITH CBI INSPECTORS WAS RAISED BY
SHRI RAMA CHANDRA KHUNTIA, HON'BLE MEMBER OF PARLIAMENT PRESENTED ON 24th MARCH 2011 IN RAJYA SABHA DURING A DEBATE ON FINANCE BILL 2011.

Sir, I would like to mention one thing here about the system of Customs. In the Department of Customs and Excise, the inspectors are very important. They are collecting the money. As I am informed, the Customs inspectors were getting their salaries and allowances on par with the CBI inspectors and other inspectors. Their salaries and allowances were reduced in the Fourth and the Fifth Pay Commissions. Now, in the Sixth Pay Commission, considering their plight, the Government has been very kind enough to bring them on parity; but, they have to get their notional promotions from 1996. They are very much in an aggrieved situation. They are very unhappy. The hon. Finance Minister should consider their case for giving them the notional promotion as it has been given to all other 16 services in this country.

CABINET APPROVED 6% DA TO CENTRAL GOVERNMENT EMPLOYEES...

DEARNESS ALLOWANCE HIKED BY 6% TO CENTRAL GOVERNMENT EMPLOYEES FROM JAN-2011...

The Union Cabinet committee today decided to increase the Dearness Allowance by 6% to Central Government employees.

Hike in the Dearness Allowance (DA) will be from 45% to 51% w.e.f.January 2011.

Release of first additional installment of dearness allowance for this year to Central Government employees and Dearness Relief to Pensioners due from Jan-2011 to compensate for essential commodities price hike.

The revised rates of Dearness Allowance from 1.1.2011 to 28.2.2011 may be paid in cash as arrears and for the month of March may be disbursed with the salary.

The enhancement of Dearness Allowance is in accordance with the accepted formula, which is based on the recommendations of the 6th Central Pay Commission.

As decided in The 4th CEC of AICEIA concluded at New Delhi on 5th of February, 2011 with the initiative of Liaison Secretary of AICEIA, a meeting took place with the All India Association Central Excise Gazetted Executive Officers (AIACEGEO) . This historical meeting took place with the efforts made by Associations of both the cadres of Superintendent and Inspector of Central Excise, Customs & S. Tax, Bhubaneswar Unit. Leaders of All India Associations of Inspector & Superintendent cadres paticipated in the meeting at Bhubaneswar on 11.03.2011 with an objective to form a Joint forum to fight the common causes of both the cadres. All India representatives participated in the meeting as follows-

It was unanimously agreed upon to fight the common causes of both the cadres from a Joint Forum. It was unanimously agreed that the agitation programme will be taken up in phased manner culminating at strike if necessary. For finalizing common agenda and other formalities, next meeting will be held at Delhi on 23rd March, 2011 at 11.00 ‘O’ clock.

On the issue of ongoing agitation programme of AIACEGEO, the Secretary General of AICEIA informed that solidarity will be extended for the ongoing agitation programme and if possible support, will be given on 30th March, 2011 agitation programme.

All India Central excise Inspectors Association shall express solidarity to the call given by All India Association of Central Excise Gazetted Executive Officers (AIACEGEO) on the parliament street in front of Jantar Mantar, New Delhi on 30th of Feb 2011.
As requested by Secretary General All India Association Central Excise Gazetted Executive Officers (AIACEGEO) we would like to request our New Delhi Circle to participate with the Superintendent Association at Jantar Mantar on 30th March sharp at 11.00 ‘O’ clock. Com. H.S.bajaj Working president AICEIA shall be in charge of the programme on that date. He is requested to contact Superintendent Association at New Delhi and make necessary arrangements. All the other units through out India are requested to wear black badges on 30th March 2011 and a memorandum should be submitted to the concerned chief commissioner highlighting the demands of the Association. As this is a solidarity move protest rally can be organized along with the Superintendent Association.

Immediately after the meeting at New Delhi with the All India Association Central Excise Gazetted Executive Officers (AIACEGEO) we shall publish our common agenda points and course of action. We would like to request each and every Circle and Branch to form a common platform with the Superintendent Association within their jurisdiction.

Recently Secretary General and president attended a meeting of the Vizag Branch where general secretary of Hyderabad and Guntur branch was also present along with other leadership of Andhra Pradesh. Mr. R. Prabhakar was reelected as General Secretary of Vizag Branch, general body meeting of Tirupati unit and the circle committee of A.P. will be formed within a short while.
Additional Solicitor General has returned the file containing the Rs. 5400/- grade pay issue to law ministry for its transmission to our Board after considering it as a fit case for filing S.L.P in Supreme Court. Hence, we are gearing up to fight the case.

CHARTER OF DEMANDS

1. Lifting of ban on ICT without any further delay.
2. Inspectors’ should get at least three functional promotion in service life, detail for in-situ promotion should be intimated to service associations.
3. Notional fixation of pay of Inspectors of Central Excise in the pre-revised scale of Rs. 6500-10500 should be provided with effect from 01.01.1996.
4. Fixation of minimum pay corresponding to pre-revised scale of Rs. 7450-11500 consequent to revision of grade-pay ordered on 13.11.2009.
5. Anomaly in pay of 1992 batch Inspectors who received ACP prior to 21.04.2004.
6. Inspectors’ next promotional Grade Pay should be Rs. 5400/-.
7. JCM s should be conducted at the Board level and at local level at regular intervals.
8. abolition of control room duties that causes unnecessary drain on manpower.
9. The 1% incentive on incremental revenue should be utilized for providing facilities and infrastructure for lower level staffs also.

Historical development in Bhubaneswar update from AICEIA

HRD is silent on senior Inspectors

Dear Comrades
 I would like to highlight some of the points on HRD letter.

1.HRD letter is silent on the Inspectors who have completed more than 20 years.

2.What about the Inspectors who have completed more than 17 years and may not have 3 years of service as supdt on completion 20 years.

3.The schemes of  in situ promotions and MACP may not run concurrently. In such a case if an Inspector has completed 19 years and got in situ supdt, will have to wait for his AC promotion till 22 years or so. Here he is loser as he is not going to get his MACP at 20 years.

Therefore, I suggest that like in IRS DC is getting JC and within a short period of 3 months or so again ADC if he has completed the requisite service for ADC, we also should be given AC or DC basing on base cadre seniority, with a gap of not more than three months.  Otherwise, the Inspectors who have completed more than 17 years of service will be at loss.

OFFICE MEMORANDUM
Subject:Delegation of powers of Head of Department to Head of Office for settling permission cases and post facto approval to reimbursementin relaxation of rules in emergent cases under CGHS/CS(MA) Rules, 1944.
The undersigned is directed to invite reference to para (ii) of this Ministry’s Office MemorandumNO.S.14012/9/75-MC (MS) dated 18.06.1982, as mentioned at point 4 under Appendix-VIII of CS(MA) Rules, 1944 relating to reimbursement in relaxation of rules in emergent cases, which stipulates that powers for settling permission cases and post facto approval should not be exercised by authorities lower than Heads of Departments.
2. The Ministry of Health and Family Welfare has examined the question of further delegation of powers to Head of Offices/officersat Under Secretary level, in such offices, which are not headed by officers equivalent to a Deputy Secretary, in the matter and it has been decided with the approval of the competent authority to delegate such powers in the following manner:-
“In case of medicalreimbursement, delegation of power can be given to Under Secretaries in the Departments of Central Government declared as Heads of Offices subject to the condition that upto Rs. two thousand for taking treatment in OPD and upto Rs. Five thousand for taking treatment in IPD under CGHS/CS(MA) Rules, 1944. This delegation of powers can be exercised as per the prescribed rate list of nearest CGHS covered city or actual whichever is lower for CS(MA} beneficiariesand as per package rate for CGHS beneficiaries in CGHS cities.”
3. This order is applicable to both CGHS and CS(MA) beneficiaries.
4. This Office Memorandum issues with the approval of Ministry of Finance vide 10 No 14(1)/E.IIA/2010 dated 06.07.2010.

THE ABOVE FORMAT SEEKS ONLY INFORMATION ABOUT THE SUPERINTENDENTS WHO HAVE COMPLETED WITH MORE THAN 3 YEARS & LESS THAN 3 YEARS OF SERVICE AS SUPDT/APPRAISER IN THE ABOVE 25 AND 20 YEARS CATEGORY. ABOUT INSPECTORS THEY HAVE ASKED ONLY ABOUT 10 YEARS AND ABOVE. THERE IS NO MENTION ABOUT THE INSPECTORS WHO HAVE COMPLETED MORE THAN 20 YEARS OF SERVICE.

IMPORTANT POINTS FROM MINUTES OF BOARD MEETING HELD ON 18.2.2011

• The proposal of Federations/Associations regarding filling of all the cadre restructuring vacancies by only promotion appears to have been accepted except Inspector grade where there are no much feeder strength.
• It is understood that the board has taken note of the alarming situation of stagnation in Group ‘B’ where only one functional promotion during average service span of 35 years.
• Creation of ASI Grade –I & II for promoting Head Havaldars
• The Cadre Control Commissioners to be given more powers.
• Guwahati Commissionerate staffing requirements have been taken into account.
• The Board approved in principle the changes in Cadre Restructuring proposal.

IN SITU PROMOTIONS

• Revision of ratio to 15:2:1 for promotion on the basis of the cadre strength of the three feeder streams.
• Grant of in situ promotions to the officers of the stagnated cadres
• Promotion to JTS on the basis of the base-cadre seniority.
• In situ promotion to Inspectors after 10 years as Supdt.
• In situ promotion to Supdts. as AC after 20 years combined or Inspector & 3 years Supdt.
• In situ DC after 5 years as in situ AC
• Other proposal service will be counted from Inspector for JTS making the Supdt promotion irrelevant.
• The Board approved in principle the proposal of in situ promotions to Gr. B executives and the appointed team to submit its recommendations by 31.3.2011.

A GRAND FAREWELL WAS GIVEN TO RETIRING OFFICER ON 25.2.2011 AT NIZAMABAD DIVISION. SRI. M.R.REDDY DEPUTY COMMISSIONER FACILITATED THE SRI. JAGAN MOHAN RAO & HIS FAMILY ON THE OCCASION.ALL THE OFFICERS OF NIZAMABAD DIVISION HAVE CONVEYED THEIR BEST WISHES TO SRI. JAGAN MOHAN RAO AND HIS FAMILY.

IN INITIAL ORDER 10 TO 15 PROMOTIONS MAY BE GIVEN. AS IN PRACTICE ALL PROMOTED OFFICERS ARE LIKELY TO BE POSTED TO VIZAG ZONE. IN FACT IT IS LEARNT THAT THERE ARE ABOUT 25 VACANCIES IN BOTH HYDERABAD & VIZAG ZONES BUT, ALL ARE NOT LIKELY TO BE FILLED UP.
