APPROVAL OF CR OF CBEC BY COS BY- CENGO NEWS CORNER ON 31.08.13.


The CR proposals of CBEC have been cleared by COS on 27.08.2013. Many people have contacted me to inform them about which batch officers will be marched ahead to lowest rung of GR-A in IRS cadre. In this connection ,I would like to inform that total nos.of AC/DC posts likely to be created in course of such CR during 2013-14 come to 2868 nos. Total nos.of posts likely to be vacated during 2013-14 on accounts of promotions to higher posts come to 492 nos. Existing vacancies during 2012-13 & 2013-14 and posts likely to be vacated during rest of the year 2013-14 on account of retirement and promotions against existing vacancies in higher posts come to around 300. Thus t otal posts of 3660 nos. in AC grade will be available and out of such posts only 150 will be allotted to DR. The remaining 3510 will be filled up on promotions from Gr-B gazetted. In the 13.2.1 ratio, only 2850 nos.of Superintendent of Central Excise will likely to be promoted. Therefore the general category officers who joined on or before 31.12.1983 as Inspector and promoted to the grade of Superintendent during 2002 will be promoted provided cabinet approves for implementation of CR at one stage during 2013-14. 
Similarly 8150 nos( 5150+2850) Inspector will be promoted to the grade of Superintendent. This will some how solve the regional disparity in promotion prospectively. But the Examiners of 2000 batch will be promoted to AC. The right to equality guaranteed under Article 14 the position is well settled that the said right ensures equality amongst equals and its aim is to protect persons similarly placed against discriminatory treatment. It means that all persons similarly circumstanced shall be treated alike both in privileges conferred and liabilities imposed. Conversely discrimination may result if persons dis similarly situate are treated equally. Even amongst persons similarly situate differential treatment would be permissible between one class and the other. In that event it is necessary that the differential treatment should be founded on an intelligible differentia which distinguishes persons or things that are grouped together from others left out of the group and that differentia must have a rational relation to the object sought to be achieved by the statute in question.” Therefore it is now required that all Associations should demand for parity amongst the Examiners. If parity with Examiners will be granted then automatically, the regional disparity will be removed. Recently, I got a message from Coimbatore that SC/ST Association are moving to CAT to stay the CR on the ground that no roaster register is being maintained by Board . Similarly , I got a message from Mumbai that Pune, Mumbai and Kolakata associations are moving to CAT (PB) to obtain a stay on implementation of CR on the ground that first regional disparity should be removed before implementation of CR. Hence CR of CBEC may not be implemented during next 3 years at least.

Dear Sir
The aspirations of Mumbai, Pune and Kolkata officers are fair enough and should be respected.We can't afford to let down our own brothers while fighting injustice.
It is ridiculous to think that parity with examiners can solve problems. Then, Parity with Income tax inspectors can solve more problems and we need not have fought the ratio case.

In-situ promotion may help to eradicate the things like regional disparity, stagnation etc. As already approved some temporary post at AC/DC level, so the promotee promoted under in-situ scheme (time bound promotion scheme) may be considered as permanent and temporary for functional purpose of post. Those promoted excess against the sanctioned strength should be considered as temporary. They can exercise the power of new post but they may have to do the function of previous post also. Eg. One Superintendent promotes to AC in-situ, he can exercise the power of AC, but he may have to do work of Superintendent also. Again, one Inspector promotes to Superintendent, he can exercise the power of Superintendent, but may have to work of Inspector also.
Moreover, the in-situ scheme should be run up to the level of Additional Commissioner. The following time table may be considered for the purpose-
In nut-a-shell, the following may be the time periods for in-situ at various entry-level-

However, a factual study may be undertaken against the presents strength and status of various cadres. If needed, a “CBEC administration, Office Procedure and Recruitment Rules” may be formed which can provide broadly everything for the employee under CBEC.

(i) DC:- after 4 years of AC;
(ii) Jt. Com:- after 6 years of DC and after 10 years of AC;
(iii) Addl. Com.:- after 8 years of JC and after 18 years of AC;
(iv) Commissioner onward:- No in-situ promotion.
In short, 1st, 2nd & 3rd in 4, 6 & 8 respectively or 4, 10 & 18 years respectively & cumulatively.

2. Promotion of direct Inspector- First in 5 years, second in 6 years, third in 7 years, fourth in 8 and fifth in 9 years. Five in-situ promotions as given below-
(i) Superintendent:- after 5 years of Inspector;
(ii) AC:- after 6 years of Supdt and after 11 years of Insp;
(iii) DC:- after 7 years of AC and after 18 years of Insp;
(iv) Jt. Com:- after 8 years of DC and after 26 years of Insp;
(v) Addl. Com.:- after 9 years of JC and after 35 years of Insp.
(vi) Commissioner onward:- No in-situ promotion, have to compete with direct.

(ii) ASI:- after 7 years of Havaldar and after 13 years of Sepoy;
(iii) SI:- after 8 years of ASI and after 21 years of Sepoy;
(iv) Inspector:- after 9 years of SI and after 30 years of Sepoy;
(v) Superintendent:- after 8 years of Inspector and after 40 years of Sepoy.

6. Superintendent will hold the charge of AO & ACAO.

Fighting for justice is never wrong! But fighting for milk is! It gives an opportunity to divide and rule. Leadership should look at justice and not milk.

It's OK to fight...but what about the persons who had put in abt 15 to 18 years as Superintendents and still not getting promotion and who are on the verge of retirement? It would be unfair to them. Let the promotion process start and put the grievances also thru the platform of UNION which would give relief to retiring officers in 2014.

Every one will support the legitimate demand for justice. But it should not deprive the poor superintendents who are at the verge of retirement after serving 18-20 years in the same grade.

True. And it should not deprive our poor senior brothers of Mumbai and Kolkata to retire after one promotion in a career spanning 39 years!

To all respected Sirs, I am not understanding that why the parity with examiner can be done in the present cadre review during the year 2013. We should solve/minimize the regional problems during the process of cadre review. If we want something we must ready to loose something And when we reached on compromising point the problem never come back.But it is never incorrect fighting for justice is wrong at present time it cannot be compared by fighting cat.
