Many of our
members are having a doubt in their minds that
our AIB in not showing any
interest for removal of regional
disparity in promotions as existed in our
cadre. But this
is not at all a fact; our Association is fully concerned for
removal of the same. Recently DG/HRD vide its
letter dated 04.09.13
and 09.09.2013 has proposed for
preparation of unified
seniority list of Inspectors of
Central Excise on all India basis to
remove regional
disparity for promotion to the next grade. What DG/HRD
proposed that
first it would prepare one unified seniority
list of all existing Inspectors
considering the merit lists
of direct recruit Inspectors and date of DPCs of
promotee
Inspectors, thereafter all promotions to the post of
Superintendent
would be made basing on such seniority list
prospectively. DG/HRD is trying to
remove the regional
disparity in prospectively. But this proposal is against
the
recommendations of Bhardwaj Committee and Board
minutes of 97 and
12.01.2011 for merger of all 3 base
cadres( Inspector/PO/Examiner) and
preparation of
unified base cadre seniority . The Apex
Court has
already decided that “ If on judicial scrutiny it
cannot stand the test of
reasonableness and
constitutionality it cannot be allowed to continue
and has
to be struck down”. Since the case filed
by Mr Laxaman Rao against the Supdt.
Central
Excise Recruitment Rules was rejected by Apex Court,
our
Association has no other option except to
approach CAT in a
different footing for parity
with Examiner of Customs to solve inter cadre
as
well as intra cadre disparity. Therefore OA No.
2323 was filed in the Delhi CAT by
our Association
with the prayer to issue direction to
amend/revise the
Recruitment Rules to bring all the Inspectors
(i.e.,
Inspectors of Central Excise, Preventive
Officers and Examiners of Customs)
recruited in a
particular year through All India Combined Examination
in parity as per their seniority position in respect of their
service
conditions and promotions to maintain the principal
of equal opportunity
& equality before law and to
save the senior Central Excise officers
from humiliation
of working under their juniors recruited much after in
Customs belonging to the same cadre of Inspector in CBEC.
If this case will be decided in our favour definitely there
is
a hope for removal of inter cadre as well as intra cadre disparities
as
existed in our cadre.

Unless we agree and admit that it is a humiliation for a central excise officer to work under intra cadre junior or serve as an inspector even when his intra cadre junior is promoted as superintendent and AC ahead of him, parity with inter cadre or any talk of humiliation will not work. We experienced it for the past 8 years ever since the Bharadwaj Committee report is out. The first step for the inter cadre parity is achieving intra cadre parity. If we fail, the justification for inter cadre parity will be lost and diluted.

it is detrementing and discriminating, collectively humuliating to suffer doubly. Adding to the owe of stagnation in promotion, the base year of seniority is wrongfully erred. unless CBEC accept the date of advertisement for recruitment as the base date for seniority, like CBDT, vide HC order has adopted, all india seniority will be another humiliation for direct recruits. Please Secretary and President, take up this matter which is also pending with CBEC, and highlight the same before drawing all india seniority list. Other wise strong protest is likely by DR.
from the seniority list of Kolkata Zone prepared as on 31.03.2010, it is quite cleared that how the men who are in the power can manage all things.....between 2000 to 2010 no list was published. In between these years 600 and above promotions were granted. It is welknown that after cadre restructuring in 2002, one time relexation was available only on those posts which were created as a result of restructuring. But at that time all regular vacancies were filed by promotions.After joining of 2003 batch dpc was held in 2007 and to give them notional seniority all promotees were placed before 2003. No rules were followed during prepration of list. From 2003 onwards all direct recruites were placed in one place. No ratio was followed by the cadre controling officers. In Kolkata Zone no direct inspector will get promotion in upcoming 5 or 6 years.
shillong zone suffer the most in stagnancy. it is seen that Direct recruit of the same batch who is posted in other zone not by choice has already become Supt , even AC/DC,but in shillong his batch mate is still inspector. He has srve below his own batch mate. It is not his choice to be in shillong zone. He also needs promotions but helpless. What is discrimination in the indian constitution? is this one of the blind eye of equality. Nobody has been paying any attention to this in justice. How long will CBEC, Association, etc discriminate us. are we not a part of this organisation or department. we are working not lesser than the rest of the zone in collecting revenue. Are we this departments street childrens, begging for justice but neglected in the dumping ground. We the new generation DR are will no longer accept this. All stone will be turned to get ourselves treated as the genuine children of this department.
There are two solutions to remove regional disparity as detailed below:-
1)All India seniority list as suggested be prepared and then promotion be made to Supdt. cadre according to their seniority. OR
2)Promotion upto the grade of Supdt. would continue to be made in the existing pattern. But for the promotion to the grade of AC, total length of service from joining as Inspector to be counted. In such promotions, regional disparity will be removed atleast in the cadre of AC.
I think the second suggestion will be more pragmatic, which can be accepted by all without any dispute.
Now take this. Long awaited CR is now a reality. Surprisingly All association including all india association is quietly accepting it and many junior inspectors are now becoming superintendents. Nothing has been done nothing will be done. reasons.......? Any way congratulations to all colleagues and specially who are becoming out of turn. Unfortunately all our associations are hopeless and this incident has put full stop on their existence.
